IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE OUR PLATFORMS. By continuing to use our Platforms, you agree to be bound by these Terms and Conditions.
1. DEFINITIONS AND INTERPRETATION
a. “Device” means any device that can access the Website such as a computer, a mobile phone or a digital tablet.
b. “Mall” means Westgate Shopping Mall situate on Title Numbers Nairobi/Block 7/77 and Nairobi/Block 7/70 on Mwanzi Road, Nairobi Kenya.
c. “Mobile App” means the Westgate Shopping Mall mobile application owned and operated by SHL downloadable from Google Play Store and the App store.
d. “Personal Data” is any information that relates to an identified or identifiable individual.
e. “Platforms” means the Website and Mobile App.
f. “Processing" means any operation or sets of operations which is performed on Personal Data or on sets of Personal Data whether or not by automated means, such as (a) collection, recording, organisation, structuring; (b) storage, adaptation or alteration; (c) retrieval, consultation or use; (d) disclosure by transmission, dissemination, or otherwise making available; or (e) alignment or combination, restriction, erasure or destruction and the word “Processed” shall be construed accordingly.
g. “Services” refers to the services offered in the shops, restaurants and service provider stores located in the Mall; including online booking services with respect to movies aired in the cinema and purchase of gift vouchers.
h. "User" means any person who enters or uses the Platforms notwithstanding the fact that such a person only visited the home page of the Platforms.
i. “We” or “Us” or “SHL” means Sony Holdings Limited, the registered owner of the Website and Mobile App.
j. “Website” refers to this website, accessible from Westgate Shopping Mall - Nairobi's premier shopping Mall.
k. “you” means the individual accessing or using the Services on the Website or Mobile App, or the company, or other legal entity on behalf of which such individual is accessing or using the Services on the Website or Mobile App, as applicable.
2. ACCEPTANCE
By accessing and using our Platforms, you signify your agreement to our Terms and Conditions. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE OUR PLATFORMS. Your continued use of our Platforms following the posting of any changes to these Terms and Conditions will mean you accept those changes.
3. PURPOSE
The Platforms provide information about the Mall including the facilities and Services offered therein. The content is provided for general information purposes only.
4. ONLINE BOOKINGS, PURCHASES, ENQUIRIES AND CAREER APPLICATIONS
The Platforms allow Users to make online movie ticket bookings as well as purchase the Mall’s gift vouchers. In addition, Users may also lodge tenancy, licensing and activation queries on the Platforms. For those seeking employment opportunities, Users may submit job applications via the Career Portal for advertised career vacancies.
5. PRIVACY
We take all reasonable steps to protect the Personal Data of Users. Further details on Processing of User Personal Data are provided in our Privacy Policy.
6. SECURITY
We take all reasonable steps to secure the content of the Platforms and the Personal Data provided by and collected from Users from unauthorised access and/or disclosure.
We may encrypt any content or communications from and to the Platforms and provide digital authentication of any page on the Platforms.
Users may not deliver or attempt to deliver, whether on purpose or negligently, any damaging code, such as computer viruses to the Platforms or the server and computer networks that support the Platforms. Notwithstanding criminal prosecution, any person who delivers any damaging code to the Platforms, whether on purpose or negligently, shall, without any limitation, indemnify and hold us harmless against any and all liability, damages and losses we may suffer as a result of such damaging code.
Users may not develop, distribute or use any Device to breach or overcome the security measures of the Platforms and we reserve the right to claim damages from any and all persons concerned with a security failure or breach.
Any User who commits any of the offences detailed in sections 14 to 21 of the Computer Misuse and Cybercrimes Act (CAP 79C) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by us.

10. NO WARRANTY
The hyperlinks, information and materials contained in our Platforms, including text, graphics, links or other items are provided "as is," "as available". We do not warrant the accuracy, adequacy or completeness of the information and materials and expressly disclaim liability for errors or omissions therein. No warranties of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third-party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, are given in conjunction with the information and materials.
11. EXCLUSION OF LIABILITY
In no event will We be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Platforms or use thereof or inability to use by any party, or reliance on the contents of the Platforms, or in connection with any failure of performance, error, omission, interruption, defect, delay or failure in operation or transmission, computer virus or line or system failure, even if We or our representatives are advised of the possibility of such damages, losses or expense. Hyperlinks to other internet resources are at your own risk. The content, accuracy, opinions expressed and other links provided by these resources are not investigated, verified, monitored, or endorsed by us. This exclusion clause shall take effect to the fullest extent permitted by law.

13. GOVERNING LAW & JURISDICTION
The Platforms are hosted, controlled and operated from the Republic of Kenya and therefore the Kenyan law enforced by Kenyan courts in Nairobi governs the use or inability to use the Platforms, their content, Services offered and these terms and conditions. By accessing and using our Platforms, you agree that the laws of Kenya shall govern such access and use and you agree to submit to the exclusive jurisdiction of the courts in Nairobi, Kenya.
14. PAYMENT QUERIES
For any payment related issues arising from movie ticket bookings made through the Platforms, including failed or incomplete transactions, duplicate charges, delayed confirmations, refunds or reversal requests, Users shall promptly contact Telephone Number +254114133630 or send an email to info@westgate.co.ke. All payment enquiries shall be addressed in accordance with SHL’s policies and verification procedures. Refunds or reversals, where applicable, shall only be processed upon confirmation of the relevant transaction details from the User and the relevant payment service provider. SHL shall not be liable for any delay, error or failure attributable to third party payment processors, banks or network operators but will provide reasonable assistance to facilitate lawful resolution.

f. “Processing" means any operation or sets of operations which is performed on Personal Data or on sets of Personal Data whether or not by automated means, such as (a) collection, recording, organisation, structuring; (b) storage, adaptation or alteration; (c) retrieval, consultation or use; (d) disclosure by transmission, dissemination, or otherwise making available; or (e) alignment or combination, restriction, erasure or destruction and the word “Processed” shall be construed accordingly.
g. “Services” refers to the services offered in the shops, restaurants and service provider stores located in the Mall; including online booking services with respect to movies aired in the cinema and purchase of gift vouchers.
h. "User" means any person who enters or uses the Platforms notwithstanding the fact that such a person only visited the home page of the Platforms.
i. “We” or “Us” or “SHL” means Sony Holdings Limited, the registered owner of the Website and Mobile App.
j. “Website” refers to this website, accessible from Westgate Shopping Mall - Nairobi's premier shopping Mall.
k. “you” means the individual accessing or using the Services on the Website or Mobile App, or the company, or other legal entity on behalf of which such individual is accessing or using the Services on the Website or Mobile App, as applicable.
2. ACCEPTANCE
By accessing and using our Platforms, you signify your agreement to our Terms and Conditions. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE OUR PLATFORMS. Your continued use of our Platforms following the posting of any changes to these Terms and Conditions will mean you accept those changes.

The Platforms provide information about the Mall including the facilities and Services offered therein. The content is provided for general information purposes only.
4. ONLINE BOOKINGS, PURCHASES, ENQUIRIES AND CAREER APPLICATIONS
The Platforms allow Users to make online movie ticket bookings as well as purchase the Mall’s gift vouchers. In addition, Users may also lodge tenancy, licensing and activation queries on the Platforms. For those seeking employment opportunities, Users may submit job applications via the Career Portal for advertised career vacancies.
5. PRIVACY

6. SECURITY
We take all reasonable steps to secure the content of the Platforms and the Personal Data provided by and collected from Users from unauthorised access and/or disclosure.
We may encrypt any content or communications from and to the Platforms and provide digital authentication of any page on the Platforms.
Users may not deliver or attempt to deliver, whether on purpose or negligently, any damaging code, such as computer viruses to the Platforms or the server and computer networks that support the Platforms. Notwithstanding criminal prosecution, any person who delivers any damaging code to the Platforms, whether on purpose or negligently, shall, without any limitation, indemnify and hold us harmless against any and all liability, damages and losses we may suffer as a result of such damaging code.
Users may not develop, distribute or use any Device to breach or overcome the security measures of the Platforms and we reserve the right to claim damages from any and all persons concerned with a security failure or breach.
Any User who commits any of the offences detailed in sections 14 to 21 of the Computer Misuse and Cybercrimes Act (CAP 79C) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by us.

13. GOVERNING LAW & JURISDICTION
The Platforms are hosted, controlled and operated from the Republic of Kenya and therefore the Kenyan law enforced by Kenyan courts in Nairobi governs the use or inability to use the Platforms, their content, Services offered and these terms and conditions. By accessing and using our Platforms, you agree that the laws of Kenya shall govern such access and use and you agree to submit to the exclusive jurisdiction of the courts in Nairobi, Kenya.

SHL shall not be liable for any delay, error or failure attributable to third party payment processors, banks or network operators but will provide reasonable assistance to facilitate lawful resolution.
